Hmmmm yeah it seems odd seeing it doesn't it.I'm guessing there's a loophole of sorts given that it it doesn't use the word tobacco or have a picture of it Either that or someone's gonna be in trouble! Well I suspect that it is because it is not a tobacco product that is being advertised. I assume if there was enough general demand to satisfy the cost of a ad in a national newspaper then things like humidors or ashtrays would be similarly 'ok'.
The wording of the act states:
- “tobacco advertisement” means an advertisement—
(a) whose purpose is to promote a tobacco product, or
(b) whose effect is to do so, and
- “tobacco product” means a product consisting wholly or partly of tobacco and intended to be smoked, sniffed, sucked or chewed.
