    Obviously this is all hypothetical at the moment, I still think Cuba ought to try to avoid Courtrooms and brand name wars. She could help herself by trying to protect her geographical assets. In the same way that Champagne can only be called Champagne if it comes from the Champagne Region of France. Pinar del Rio is unique. Likewise Havana (Habana/Habano), nothing tobacco related should be allowed to use those statements unless it is grown and manufactured in those areas .... would wipe out an awful lot of NC smokes.

          i suspect this kind of international application controlee type situation will carry a lot of weight in any legal battle.

            Arf: you looked at it from a practical view. That's what I do as I'm a scientist first and everything else second. But that just won't be what'll happen. Never discount the guts of others. Their traditionalistic views will potentially be their downfall. The Yank companies don't care about tradition as they don't have the history and heart behind it. All they have is recognition and pride (another silly thing).
            The Cubans know that and would fight like hell to get the naming rights. In the end, they deserve it, no?

            I guess one could always use Hanlon's razor here. Never attribute to malintent what one could simply attribute to stupidity.
            Traditional methods and rights might be practically stupid. But just imagine if you were a Cuban director. Would you want your brands to change in order to accommodate some bullshit Yanks just because they're a tad more powerful?

              That's one problem .... but in muddier water there are the ex-pat Cubans who owned the brands and fields prior to the Revolution, and who's names are on many Cuban boxes.

                The brand name changes (in the US at least) may be a possible, and perhaps a probable, outcome. In my limited reading of articles and websites on the cuban brands in the US, the only one the cuban government seem to object to being used is Cohiba, whereas the other's are never mentioned (for example, in the link TJ posted, they went to court over Cohiba, but none of the others). Assuming this is because the split between the CC and NC versions of the other brands came under different circumstances (and as such cuba/Habanos do not feel that they have as big a claim to them in the US), this might mean that they just cut their loses and just change the brand names, particularly if it means they can start accessing the US market quicker!

                  Cohiba only because it is post revolution. Also, [I guess] partially because of the fetishism.

                  La Gloria Cubana, Partagas, Montecristo: all pre revolution. Cubans have more of a case if they just stick to bitching about Cohiba.
