    Driving to work this morning through Erdington as always en route to Aston im waiting in line in heavy traffic. My driver-side window is down and Im a third of the way through a HdM Epi 2 which I was contemplating smoking last night. I always smoke on the way into work. Anyhow Im in the left hand lane and see a police car crawling next to me in the right had lane and comes to a stop next to me. I take no notice until the officer gets my attention. Two male officers and a female in the back seat. The officer says" Excuse me but did you know that driving with the cigar in your hand is the same as if it were a mobile phone"??? I looked at him and said" Id like to see you try and make a call on it" and tried to hand it to him. He was not amused as I think I stole his thunder. He looked at me and said "I dont think you are in full control of your vehicle" I said" is there a current law that states I cant smoke in my car whilst driving" Not yet came the reply. I just smiled at him and continued to smoke. I think he expected me to throw away a perfectly good ?14 cigar. I see so many kids smoking spliffs on the way to work in the mornings its unreal and he gave me a lecture!!! The motorist and smoker a sitting target in the eyes of the system.

    At least you didn't get a ticket for lack of control, but they would have to prove it by your driving. And it can;t be the same as there is a law against using a mobile phone and last time I checked mobiles aren't made from tobacco!!!!

        Dear god what is this place coming to, you can sell class A drugs and not even get a slap on the wrist but smoking in your car..........I'm beginning to really hate this country.

          Best piece of advice i have ever been given for dealing with police officers was this, before engaging in any conversation ask them for a piece of paper and a pen to write with so you can record the conversation word for word, this is a legal right, and one they like to keep quiet about. usually sorts out the Roscoe's from the decent plod.

              A fine start to your day then, bet he thought he was showing off by trying to intimidate you. If he really thought you were doing anything wrong you would have been pulled over and given a ticket surly.

              Im also having a real fun morning. At a customer site installing 3 new PCs, which were ordered just after they told us they no longer wanted our services after 7 years. Bit of a kick in the teeth really...

                Technically I believe you 'can' get done for anything that keeps your hand(s) busy rather than on the wheel/gear stick, so mobile phones were illegal before the specific rule, but they they had to prove it meant you were driving dangersouly which was a lot more difficult than a specific rule about not using a mobile while driving... Load of BS though, he'd be pulling every other vehicle over for smoking, or drinking, or eating, or picking their nose...

                  What about the people who are screaming a the brats in the back or event just being distracted by them. Is that driving without having control of the vehicle too?

                    Apparently I just found out that a couple of people have been charged by the police. One was charged for eating an apple whilst driving, another for eating a sandwich and a third for drinking coke out of a can. I drive an automatic car, no gears, no clutch so I have less to operate. What about taxi drivers on the their radios all day, the police on their radios, RAC and AA recovery drivers?? Or is it one rule for us and one for them?? sorry guys I'm just pissed off with the situation. We work hard and should be left alone to enjoy our little pleasures we pay tax's on every turn and still cant be allowed to be ourselves. Rant over.. blood pressure returning back to normal.. vein in neck disappearing.. where's the key to the humi

                          I actually had to pull off the M5 a few months ago. Our 4 year old was having a major strop and I just knew I was going to loose it if we carried on. Made a sharp exit for us all to calm down before carrying on.
