  • FDA Ruling

Surprised this hasn't popped up here yet.

The Food and Drug Administration announced this morning tough new regulations on the entire U.S. tobacco industry, including the segment that makes and markets premium, handmade cigars. | Cigar Aficionado

Given that it would cost hundres of thousands to license a new brand or line, this could kill a good number or smaller producers of cigars. So I assume all the NC lovers here will be rather concerned as I am? :S

I listen to several American cigar podcasts and thus decision by the FDA has come as a hammer blow. It was looking like the cigar industry would avoid the stricter "Option 1" scenario and have exemption from this draconian regulation. If this is passed it could effectively destroy most of the U.S cigar industry. Any cigar created after the 2007 date would need FDA approval to be sold, and that means "any " cigar. If a range has 5 sizes that is 5 different cigars in the eyes of the FDA. A licence for each if these would be about $300k. Any small boutique cigar maker will vanish. I know most people on this forum are CC fans but I enjoy many NCs. Fingers crossed the Cigar Rights Of America can fight it, but many people I listen to fear the end is nigh.

Once the US market is officially open for them, that will be inevitable. But an open US market in combination with lots of producers going out of business, will definitely drive prices up tremendously...

I am all for regulation and higher prices were what drove me to quit cigarettes over 10 years ago. But this is not big tobacco which will hurt by it. It won't solve any health problems as cigars are rather a niche market when it comes to tobacco. Instead it will kill a lot of small businesses and drive up the power and wealth of big tobacco.

I'm not sure I was eligible to sign, but I did sign the online petition anyway...

Even if the U.S market did open for cuban cigar manufacturers they would still have to go through the same approval system as the non cuban companies which could take up to 3 years. Also factor in that the trademark names of all the top cuban brands are held in the U.S by the non cuban manufacturers, e.g Montecristo could not sell under that name in the U.S as the American Montecristo holds the trademark. It would take years to sort out the legalities, as obviously the U.S companies will do everything in their power to hold up the sale of CCs in the American market.

The lawsuits has been filed against the FDA now

I'm guessing this fight is just getting started

The lawsuit vs the CRA, CAA and IPCPR contains at least 9 counts. What are those counts? The Cigar Authority lets you know....

It's heavy stuff for pipe tobacco blenders and even pipe manufacturers too. However, I've read some posts elsewhere that some statesmen have ruled pipes out of the FDA shite. I don't know if that's a national attitude. Prior to reading that, pipes are classed in the same way as tobacco, and as a 'part' rather than an accessory. Only in the US

Just came across this on twitter

FDA LOSES LAWSUIT OVER TOBACCO LABELING CHANGES

Turns out, if you put a new band on a cigar, it's still the same cigar after all. Yesterday, the U.S. Food & Drug Administration (FDA) lost its court
